1. General Points
1.1. The general terms and conditions of sale (hereinafter referred to as CGV) define the provisions and services between Miller Services (also referred to as Barbe à Papa Machine or www.barbeapapa-machine.ch) and its customers.
1.2. Divergent agreements are valid only if they have been approved in writing by Miller Services.

2. Offer
2.1. The offers from the online store www.barbeapapa-machine.ch are provided without commitment and therefore do not constitute firm offers. The confirmation by email and the delivery of the goods are decisive for the order. Offers are subject to the availability of items/products from our suppliers or manufacturers.
2.2. All information about products, product photos, technical specifications, etc. are provided without warranty on the www.barbeapapa-machine.ch online store website. The valid specifications of the manufacturer are decisive at the time of delivery.
2.3. Detailed product data comes from Miller Services or other suppliers and may be used exclusively by Miller Services.
2.4. Miller Services assumes no responsibility for the content of external web pages.

3. Price
3.1. All prices from www.barbeapapa-machine.ch include Swiss value added tax (VAT). Net prices are indicated in Swiss Francs. For orders shipped outside Switzerland, the 8.1% VAT is automatically deducted and sold tax-free. Foreign customers are responsible for paying VAT and any other applicable taxes or duties. Payments must be made according to the terms agreed upon at the time of the order.
3.2. Additional costs (e.g., delivery charges, packaging, surcharges for selected payment methods) are indicated separately.
3.3. The date of the order is decisive for determining the price. Price changes during the execution of the order are not taken into account.
3.4. Information is provided subject to technical changes, errors, and typographical errors.
3.5. Miller Services may change its prices at any time and without notice.
3.6. The selling price includes consulting and technical support services provided by the manufacturer via a dedicated WhatsApp or WeChat group, available 7 days a week, almost 24 hours a day. Upon request and in certain exceptional cases, Miller Services will provide after-sales or repair services at the customer's expense.
3.7. Consumables (sugar, water, and others) are not included in the price.
3.8. Activation and fees for any card reader are not included in the price.

4. Means of Payment
4.1. Miller Services accepts credit cards (via PayPal) and bank transfer in advance as means of payment, or as agreed conditions before purchase and mentioned in the invoice.
4.2. When paying with a debit or credit card, the amount is debited at the time of the order. Miller Services may activate or deactivate specific credit or debit cards at any time, without notice. When paying by credit or debit card, the customer's data is transmitted in encrypted form.
4.3. Miller Services invoices reminder or return fees.
4.4. In the case of advance payment, the invoice must be settled within 10 calendar days, failing which Miller Services may cancel the order.
4.5. Miller Services reserves the right to conduct solvency checks on customers and may disclose customer information to third parties for this purpose. Miller Services may exclude certain means of payment in general or for individual customers without providing justification.

5. Payment Conditions and Reservation of Ownership
5.1. If a customer is late with all or part of the payment for a purchase, Miller Services may suspend remaining deliveries, in whole or in part, without notice until the entire claim has been settled.
5.2. If a customer does not settle their claim after the payment deadline extension, Miller Services may demand compensation and proceed in accordance with the provisions of the Swiss Code of Obligations (CO). Miller Services has the right, in particular, to delegate debt collection to an external company.
5.3. Miller Services may charge surcharges for certain payment methods and change them without notice.
5.4. Products delivered by Miller Services remain the property of Miller Services until the entire purchase amount (including all surcharges) has been paid to Miller Services. The customer undertakes to take good care of the products as long as they are owned by Miller Services.

6. Orders
6.1. Orders can be placed on our website, by phone, or in writing.
6.2. Orders by minors or persons under guardianship are only allowed with the consent of their legal representative.

7. Deliveries and Partial Deliveries
7.1. Deliveries are always made by carrier or Swiss Post. Ordered goods may, only with prior agreement, be collected directly by the customer from Miller Services.
7.2. Miller Services confirms the order after its conclusion by email.
7.3. Delivery times indicated by Miller Services are provided for information only. They are not firm dates. If a delivery time cannot be met, the customer can cancel their order after the expiration of an additional period of at least 60 days, which they specify to us in writing. In this case, the customer is not entitled to additional compensation.
7.4. Miller Services may cancel confirmed orders due to external circumstances beyond its control, without resulting in financial consequences.
7.5. Miller Services may make partial deliveries as needed.
7.6. Miller Services may assign deliveries and partial deliveries to different transport companies. Delivery is generally made to the curb, not to the floor or apartment of the customer. Delivery of small appliances to the customer's door or mailbox is at the discretion of the transport company in question.
7.7. Miller Services does not dispose of old appliances.

8. Transport Risk, Transport Damage, and Transport Guarantee
8.1. The merchandise is shipped at the customer's risk and peril. However, the customer has limited coverage under the transport insurance.
8.2. The customer undertakes to immediately check that the delivered goods are correct, complete, and in good condition. Damage to delivered goods must be reported to the transport company as soon as possible, no later than 5 calendar days after delivery.
8.3. In the event of complaints, all parts of the original packaging must be kept until written approval is obtained from the transport company or Miller Services.
8.4. At the conclusion of the order, the customer receives transport warranty for transport damage and losses. Only the damage actually caused during shipment is covered, up to the maximum value of the goods at the time of ordering. The customer is exclusively entitled to repair of defects, replacement (replacement delivery), or compensation for depreciation. The decision on repair or replacement of a device is the responsibility of Miller Services or the manufacturer. Damage to delivered goods must be reported by email to Miller Services as soon as possible, no later than 5 calendar days after delivery. In the event of complaints, all parts of the original packaging must be kept.
8.5. Subsequent subscription to transport warranty is not possible.
8.6. Goods sent directly by the customer for repair without being reported to Miller Services cannot be subsequently processed under transport warranty.

9. Return and Exchange
9.1. In general, goods cannot be returned.
9.2. The return of delivered goods is possible in certain exceptional cases, which always require written approval from Miller Services. In this case, the customer receives a number and address from Miller Services for return.
9.3. Goods must be returned in the original condition, complete with all accessories, and accompanied by the purchase receipt. The return of goods is at the expense and risk of the customer.
9.4. Concerning returns not agreed upon with Miller Services, Miller Services is entitled to demand compensation from the customer.
9.5. Goods returned incomplete, with missing accessories, or to an incorrect address will be returned to the customer. In this case, Miller Services charges the customer a fee for the additional processing required.

10. Legal Warranty / Warranty Provisions
To the extent permitted by law, Miller Services disclaims any liability under the legal seller's warranty obligation, which is replaced by the following provisions.
10.1. The warranty provisions (especially the warranty period) of the manufacturer are decisive for items purchased from Miller Services. Customers outside Switzerland / CH must claim warranty directly from the service center indicated by the manufacturer. The warranty period is generally 18 months for the machine, 1 year for the burner, and 2 years for the PLC (motherboard). No warranty or after-sales service is provided by Miller Services. Replacement of defective parts will be provided free of charge during the warranty period by the manufacturer.
10.2. The invoice serves as a warranty certificate and must be kept carefully.
10.3. In general, the manufacturer's warranty provisions are limited to the exchange of the defective item or component, excluding uncovered cases. Exclusion reasons include damage caused by natural elements, moisture, damage due to shocks or falls, normal wear and tear, software problems, mishandling, damage caused by third parties, as well as non-compliant interventions or modifications. Wear parts are excluded from the warranty. The decision to repair or replace a device generally rests with the manufacturer. The exchange of a device or component does not renew the warranty period. During the repair period, the customer is not entitled to a replacement device. Home service is not covered by the warranty. The customer cannot make additional claims under the warranty. Subject to divergent provisions from the product manufacturer or Miller Services.

11. Installation, Repairs, and After-Sales Service
11.1. Once the machine is received, the manufacturer's after-sales service will take care of the installation and follow-up of the machine, without time limit and available 7 days a week via a (WhatsApp or WeChat) group. This work can be carried out by the customer and without the assistance of an independent technician. All interventions, repairs, updates, or other necessary actions must be carried out by the customer or by an independent technician, with the assistance of the manufacturer's after-sales service via the WhatsApp or WeChat group, where professional technicians and engineers will be available to offer appropriate solutions. This service is free, available 7 days a week, and 24 hours a day. Upon request and in certain exceptional cases, Miller Services may provide installation, repairs, or after-sales service, at the customer's expense.
11.2. Defective devices or components should not be returned by the customer.
11.3. Devices or components for repair should not be sent to Miller Services.
11.4. If the customer mistakenly sends a device for repair to Miller Services, an administrative fee of CHF 50.- will be charged to the customer in addition to any expenses (transport or others).

12. Certifications
12.1. The machine is sold with all certifications from the manufacturer (CE, CB, CQC, and others) necessary in the destination country.

13. Legal Forum, Applicable Law
13.1. To the extent permitted by law, the district court of Estavayer-le-Lac / Fribourg is the exclusive competent court. Only Swiss law applies.
